1. Agreement to terms

These Terms of Service ("Terms") govern your access to and use of the website operated by One Mortgage ("Company," "we," "us," or "our"), located at https://mortgage.cerberuscrm.com and all related pages, content, and services. By accessing this website, submitting a form, booking a call, or otherwise engaging with our content, you agree to these Terms. If you do not agree, you should not use this website.

Accessing the Site, in any manner, whether automated or otherwise, constitutes use of the Site and your agreement to be bound by these Terms.

One Mortgage remains the provider of mortgage services and the sender of SMS messages associated with inquiries submitted through https://mortgage.cerberuscrm.com, including when the website features an individual loan officer's branding. The website address identifies this online service; it does not replace the company's identity.

2. Company information

One Mortgage provides direct, first-party mortgage lending services. Company NMLS #13988. Our office is located at 12 Main Street, Voorhees, NJ, 08043.

3. Not a commitment to lend

This website is for informational and educational purposes only. Nothing on this website constitutes a loan commitment, pre-approval, or guarantee of any specific loan terms, interest rates, or program availability. All mortgage loan applications are subject to credit approval, underwriting guidelines, property appraisal, and other conditions. Loan terms, conditions, programs, and rates are subject to change without notice. The information provided does not constitute a loan estimate or a binding offer.

4. Not financial, legal, or tax advice

The content on this website, including but not limited to blog posts, webinars, resources, guides, and social media content, is intended for general informational and educational purposes only. It does not constitute financial advice, legal advice, tax advice, or investment advice. You should consult with qualified professionals regarding your specific situation before making financial decisions.

5. Website use and conduct

You agree to use this website only for lawful purposes. You agree not to submit false, misleading, or fraudulent information through any form, survey, or communication on this site. You agree not to interfere with or disrupt the website or its servers. You agree not to attempt to gain unauthorized access to any portion of the website. You agree not to use automated systems, bots, or scrapers to collect content from this site without our express written consent.

6. Communications consent

Separate, express SMS consent: Submitting a form, providing your phone number, requesting information, or applying for a loan does not by itself enroll you in SMS. To receive service text messages, you must personally select the separate, optional SMS checkbox on One Mortgage's own form. The checkbox is unchecked by default. Consent applies only to One Mortgage and the message types disclosed at opt-in; it is not consent for another company to contact you.

Consent is optional: You may submit a form, request services, or purchase products or services without checking the SMS checkbox. SMS consent is not a condition of purchase. Consent for calls, including automated or artificial/prerecorded voice calls, must be obtained separately where required and is not granted by the SMS checkbox.

Automated and AI-assisted messages: Where used, automation or AI does not expand the message types or communication channels you authorized. Service texts remain limited to the purposes described in Section 7.

Opt-out and revocation: Reply STOP to any SMS message to unsubscribe. We honor SMS opt-outs promptly and send no further program messages after opt-out, except one confirmation, unless you provide new consent. You may also revoke consent or request help by calling (856) 552-0714 or emailing [email protected]. We honor reasonable requests to revoke consent in accordance with applicable law.

Consent records: We maintain records of the consent disclosure, your affirmative opt-in action, date and time, source form or URL, and available supporting information such as IP address. We retain consent records in accordance with applicable legal requirements.

Applicable requirements: Our communications are subject to applicable federal and state consent, calling, and messaging requirements.

Privacy: See our Privacy Policy for information about collection, use, protection, and sharing of personal information.

7. SMS/text message terms

Program and sender: One Mortgage sends service-related SMS messages only to people who inquired directly with us and personally checked our SMS consent box. The program is limited to mortgage inquiry acknowledgements, application status updates, document requests, appointment confirmations and reminders, and customer service responses. It does not include advertising, new loan solicitations, rate offers, refinancing promotions, pre-approval promotions, or home equity offers.

How to opt in: Select the separate, optional SMS consent checkbox on our own website form at https://mortgage.cerberuscrm.com. The checkbox is visible and unchecked by default. Submitting the form alone does not give SMS consent. Consent is not required to submit the form, purchase anything, or obtain services. Third-party referrals, purchased lists, or consent given to another business do not enroll you.

Frequency and charges: Message frequency varies with your inquiry, application, appointments, and service needs. Message and data rates may apply.

How to opt out: Reply STOP to any message. We will stop program messages and may send one confirmation. You will not receive further program messages unless you opt in again.

Carrier information: Delivery depends on your wireless service and is not guaranteed. Carriers are not liable for delayed or undelivered messages.

SMS privacy: We do not sell, rent, or share mobile information with third parties or affiliates for marketing or promotional purposes. SMS opt-in data and consent are excluded from all other sharing categories. Service providers may process only the information needed to support our messaging and customer service on our behalf, under confidentiality obligations, and may not use it for their own purposes. SMS consent cannot be transferred to another sender.

Age restriction: You must be at least 18 years old to participate.

8. AI-generated content and communications

We may use artificial intelligence technology in various aspects of our operations, including but not limited to generating or assisting with marketing content, social media posts, email campaigns, text messages, voice calls, chatbots, and educational materials. In accordance with the FCC's February 2024 Declaratory Ruling, AI-generated voice communications are subject to the same TCPA requirements as traditional prerecorded or artificial voice calls.

AI-assisted communications remain limited to the specific channels and purposes you authorized. SMS consent permits only the service messages described in Section 7 and does not authorize promotional texts or voice calls. We will disclose the use of AI in communications where required by applicable federal or state law. You may request to speak with a human representative at any time.

AI is not used to make lending decisions. All credit decisions, loan eligibility determinations, and loan terms are made by licensed human professionals in compliance with the Equal Credit Opportunity Act (ECOA), the Fair Housing Act, and all applicable regulations.

9. Intellectual property

Our limited license to you: This Site and all the materials available on the Site, including text, graphics, logos, images, videos, audio, software, and design elements, are the property of One Mortgage and/or our affiliates or licensors and are protected by copyright, trademark, and other intellectual property laws. The Site is provided solely for your personal non-commercial use.

You may not use the Site or the materials available on the Site in a manner that constitutes an infringement of our rights or that has not been authorized by us. Unless explicitly authorized, you may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner or medium any material from the Site. You may download and/or print one copy of individual pages for your personal, non-commercial use, provided that you keep intact all copyright and other proprietary notices.

Your license to us: By posting or submitting any material (including comments, blog entries, social media posts, photos, and videos) to us via the Site, internet groups, or other digital venues, you represent that you own the material or have obtained the necessary permissions. You grant us a royalty-free, perpetual, irrevocable, non-exclusive, worldwide license to use, modify, transmit, sell, exploit, create derivative works from, distribute, and publicly perform or display such material.

Personal information excluded: The content license above does not apply to loan applications, private inquiries, financial or identity information, mobile numbers, or SMS opt-in data and consent. Those records remain governed by our Privacy Policy and cannot be sold, published, or used for third-party marketing under this license.

10. Third-party links and services

This website may contain links to third-party websites, embedded content, or integrations with third-party services, including but not limited to scheduling platforms, survey tools, webinar platforms, social media sites, and analytics providers. Our linking to such third-party sites does not imply an endorsement or sponsorship of such sites or the information, products, or services offered on or through the sites. We do not control these third-party services, and their use is subject to their own terms of service and privacy policies. We are not responsible for the content, accuracy, or practices of any third-party service.

11. Online commerce

Certain sections of the Site may allow you to interact with or purchase products and services from third-party vendors. We are not responsible for the quality, accuracy, timeliness, reliability, or any other aspect of these products and services. If you make a purchase from a third party linked through the Site, the information obtained during your visit, including payment information, may be collected by both the merchant and us.

Your participation in any dealings with third-party vendors is solely between you and the third party. One Mortgage shall not be responsible for any loss or damage incurred as a result of such dealings.

12. Registrations and passwords

To access certain features of the Site, you may be required to register and create an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.

13. Google API Services

This website may use Google API Services, including the Google Places API, to display reviews and location information. Our use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

THIS WEBSITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or timeliness of any information on this website, including interest rates, loan program details, or market information.

TO THE FULLEST EXTENT PERMITTED BY LAW, One Mortgage SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THIS WEBSITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

We reserve the right to modify these Terms at any time. The latest version will always be available on our website with the effective date below. Your continued use of the website after any changes constitutes acceptance of the updated Terms.

SMS consent: Changes to these Terms or continued website use do not create or expand SMS consent. New consent is required before messages outside your previously authorized scope may be sent.
